Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") outlines the acceptable and prohibited uses of the hosting services, infrastructure, and network provided by Bigframe Digital LLC ("Bigframe Digital", "we", or "us"). This policy is designed to protect our bare-metal infrastructure, ensure the highest level of performance for all clients, and maintain compliance with local and international laws.

By using our services, you agree to comply with this AUP. Bigframe Digital reserves the right to strictly enforce this policy and may suspend or terminate your services, without notice or refund, for any violation.

1. Resource Abuse and Bare-Metal Integrity

Bigframe Digital provides unthrottled bare-metal hosting without traditional virtualization caps. To protect the integrity of the servers for all clients, the following resource-abusive activities are strictly prohibited:

  • Cryptocurrency Mining: Operating any form of cryptocurrency mining software or scripts (e.g., Bitcoin, Monero).
  • Unrelated Processing: Running processes, scripts, or applications that are not directly related to the active functioning of your web application (e.g., video encoding farms, massive web scraping operations, continuous automated testing environments).
  • Network Abuse: Participating in or facilitating Distributed Denial of Service (DDoS) attacks, network probing, or port scanning.
  • The "Noisy Neighbor" Provision: Even if an application is legitimate, if it consumes a disproportionate amount of CPU, RAM, or I/O resources to the point that it degrades the performance of the bare-metal server for other clients, we reserve the right to temporarily throttle or suspend the account until the code is optimized.

2. Prohibited Content and Activities

You may not use Bigframe Digital’s network or servers to publish, transmit, or store content that is illegal, harmful, or maliciously disruptive. This includes, but is not limited to:

  • Malware and Exploits: Hosting or distributing viruses, trojans, phishing kits, ransomware, or any software intended to compromise computer systems.
  • Illegal Content: Any material that violates United States federal law, Arizona state law, or the laws of the jurisdiction in which you reside. This includes child exploitation material (which will be immediately reported to the National Center for Missing and Exploited Children and law enforcement).
  • Intellectual Property Violations: Hosting material that infringes on the copyright, trademark, or patent of others. We comply strictly with the Digital Millennium Copyright Act (DMCA) and will terminate repeat infringers.
  • Fraudulent Services: Operating Ponzi schemes, HYIPs (High-Yield Investment Programs), fake technical support scams, or fraudulent e-commerce storefronts.

3. Zero-Tolerance Spam Policy

Bigframe Digital maintains a strict, zero-tolerance policy against Unsolicited Bulk Email (UBE) and spam to protect the reputation of our IP addresses and network.

  • No Spam: You may not use our servers to send spam, unsolicited promotional emails, or bulk newsletters to lists that have not explicitly opted-in (e.g., purchased email lists).
  • CAN-SPAM Compliance: All commercial email sent from our network must comply with the CAN-SPAM Act of 2003.
  • Open Relays: You may not operate open mail relays, open proxies, or any system that allows unauthorized third parties to route traffic through our network.
  • Consequences: If your account causes our IP addresses to be blacklisted (e.g., by Spamhaus), your account will be immediately terminated without a refund, and you may be billed for the administrative costs of IP delisting.

4. Security Requirements

As part of our Shared Responsibility Model, you are required to maintain basic security hygiene on your WordPress installations:

  • Passwords for WP-Admin, SFTP, and databases must be complex and secure.
  • Outdated, vulnerable, or abandoned plugins and themes must be updated or removed.
  • If a site is compromised due to user negligence (e.g., weak passwords) and is used to launch attacks or send spam, Bigframe Digital reserves the right to suspend the site until it is professionally cleaned and secured.

5. Enforcement and Repercussions

Bigframe Digital conducts automated network monitoring to detect anomalies and abuse. If a violation of this AUP is detected, we may take any of the following actions at our sole discretion:

  • Issue a warning and require immediate remediation.
  • Suspend the offending website or entirely lock the hosting account.
  • Terminate the account permanently.

Accounts terminated for AUP violations are not eligible for any refunds under our Goodwill Refund Policy, and all associated data may be permanently deleted upon termination.
