These Terms of Service ("Terms") govern your access to and use of the web hosting services, infrastructure, and associated software provided by Bigframe Digital LLC ("Bigframe Digital", "we", "us", or "our"). By purchasing, accessing, or using our services, you ("Client", "you", or "your") agree to be bound by these Terms.

1. Description of Services

Bigframe Digital provides high-performance, bare-metal WordPress hosting, domain registration, and related digital infrastructure services. Our environments utilize dedicated server hardware, Open Lite Speed, and custom WordPress management tools. We reserve the right to update, modify, or deprecate features of our services to maintain optimal security and performance.

2. Billing, Payments, and "Goodwill" Refunds

  • Payment Obligations: Services are billed on a recurring subscription basis (monthly or annually) depending on the selected plan. Payment is due on the established billing date. Failure to remit payment may result in account suspension or termination.
  • Client Satisfaction and Refunds: Bigframe Digital operates on a foundation of goodwill and exceptional service. We do not enforce a strict "no refund" policy. Instead, refund requests are evaluated on a case-by-case basis at the sole discretion of Bigframe Digital management. We prioritize client satisfaction and will issue proportional refunds for clients who are genuinely dissatisfied with our platform.
  • Refund Exclusions: Refunds will not be granted under any circumstances to accounts that have violated our Acceptable Use Policy (AUP), engaged in illegal activity, or intentionally abused server resources. Domain registration fees are strictly non-refundable.

3. Server Resources and Fair Use

  • Bare-Metal Performance: Bigframe Digital provides premium bare-metal hosting without the use of traditional virtualization caps. We do not place hard artificial limits on CPU, Memory, or I/O speeds for individual accounts in good standing.
  • Fair Use Clause: To ensure the stability and performance of the entire server environment, all accounts are subject to fair use. You may not allow any scripts, applications, or processes to consume resources in a manner that threatens the uptime, stability, or performance of the hardware or impacts other clients. Bigframe Digital reserves the right to temporarily throttle, suspend, or isolate any account causing systemic instability until the underlying issue is resolved.

4. Included Software and Premium Licenses

  • Divi Builder: Eligible hosting plans include a complimentary license key for the Divi Builder theme/plugin. This license is provided strictly as a value-added benefit for active Bigframe Digital clients.
  • License Revocation: The Divi license remains the property of Bigframe Digital. If you cancel your hosting service, migrate your website to another provider, or if your account is terminated for violating these Terms, the provided Divi license key will be deactivated. You will be responsible for purchasing your own license from Elegant Themes to continue receiving updates.

5. Compliance and Shared Responsibility

  • Infrastructure Security: Bigframe Digital provides enterprise-grade infrastructure designed to meet strict compliance standards, including HIPAA, PCI DSS, CCPA, and NIST. We secure the underlying bare-metal hardware, network layer, and server operating systems.
  • Client Responsibility: You acknowledge a "Shared Responsibility Model." Bigframe Digital guarantees the compliance of the server infrastructure. You, the Client, are solely responsible for the compliance of your specific application. This includes maintaining strong passwords, updating WordPress plugins, managing user access, and ensuring your methods of transmitting and storing Protected Health Information (PHI) or credit card data within your site meet legal standards.

6. Backups and Data Security

  • Layered Backup Systems: Bigframe Digital provides robust, multi-tiered backup solutions, including rapid internal backups, weekly system backups, and integration options for third-party cloud storage (Google Drive, Amazon S3, OneDrive).
  • Client Liability: While we maintain these systems to the highest operational standards, Bigframe Digital does not guarantee the integrity or availability of back-up data. You are ultimately responsible for maintaining independent, off-site copies of your websites, databases, and digital assets. Bigframe Digital shall not be held legally or financially liable for data loss, corruption, or hardware failure.

7. Account Suspension and Termination

Bigframe Digital reserves the right to suspend or terminate your account, with or without notice, if you breach these Terms, violate our Acceptable Use Policy (AUP), fail to pay invoices, or engage in behavior that harms our reputation, infrastructure, or other clients. Upon termination for cause, no refunds will be issued, and all associated data may be permanently deleted.

8. Limitation of Liability and Indemnification

To the maximum extent permitted by law, Bigframe Digital LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business goodwill, arising from your use of our services. You agree to indemnify and hold harmless Bigframe Digital LLC, its officers, and employees from any claims, damages, or legal actions arising out of your website content, applications, or violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any legal action or proceeding related to our services shall be brought exclusively in the state or federal courts located in Arizona.
